Under the Civil Rights Law and Executive Order No. 11246, this company is obligated to follow a policy of non-discrimination in employment matters. Accordingly, J.B. Gibbons Construction, LLC has adopted the policy stated herein to govern the recruiting, hiring, compensation working conditions, promotion and demotion, layoff and termination. It is essential that this policy be implemented by all personnel, and it is therefore expected that all will be governed by the provisions of this program.

1. J.B. Gibbons Construction hereby officially affirms that it accepts and endorses the principle of equal employment opportunity. It has been, and will continue to be, the policy of J.B. Gibbons Construction, LLC to not discriminate against any employee or applicant for employment because of race, color, religion, sex, national origin, disability, age, marital status, sexual orientation, or veteran status. All forms of prohibited discrimination, including harassment, therefore will not be tolerated. Gibbons Construction will continue to recruit, hire, train and promote the most qualified individuals without regard to their race, color, religion, sex, national origin, disability, age, marital status, sexual orientation, or veteran status by ensuring that all employment decisions are based only on valid job requirements.

2. The company has designated one of its management team, Ms. Penny Mosley as Equal Employment Opportunity Officer to coordinate Gibbons Construction's efforts and to advise and assist all personnel in implementing this policy.

3. In recruiting personnel, J.B. Gibbons Construction will ensure that all advertisements make known the equal employment opportunity policy of the company. J.B. Gibbons Construction will endeavor, where possible, to recruit through those sources which have the widest contracts among minority groups, and will, generally, encourage affirmative action to obtain referrals among minority groups.

4. J.B. Gibbons Construction will require all personnel to offer opportunity for placement and promotion on a strictly non-discriminatory basis, and further that the demotion, layoff or termination of all employees shall be solely based upon work available and upon the skills and abilities of those personnel in the employ of the company. Gibbons Construction will also insure that working conditions throughout the Company are maintained in a non-discriminatory manner.

5. Employees and applicants for employment shall not be subjected to harassment, intimidation, threats, coercion or discrimination because they have, in good faith, filed a complaint pursuant to this policy; assisted or participated, in good faith, in an investigation or review related to the administration of this policy; opposed any act made unlawful by laws requiring equal employment opportunity; or exercised any right protected by laws requiring equal employment opportunity.

6. In subcontracting work to others, J.B. Gibbons Construction will encourage its subcontractors to pursue a policy of non-discrimination, and will encourage its subcontractors who follow such a policy. Gibbons Construction will further advocate that all subcontractors take affirmative action to insure that minority group personnel are given every opportunity to qualify.

7. Finally, J.B. Gibbons Construction shall take those steps which it deems effective to make known to all employees and to the public that the company is actively and affirmatively pursing an equal employment opportunity policy, and that it endorses the aims of those civic and other groups which are promoting the acceptance of such a policy by the business community.
